A creditor’s ability to reach inside the FLP is limited by law, and any claims are often restricted to distributions that have not yet occurred.

Typically, older family members serve as general partners, maintaining full control, while limited partnership interests are transferred to children or grandchildren. This not only helps manage estate tax exposure but also preserves control and creates valuation discounts for transfer purposes. The FLP structure ensures centralized control while building in substantial asset protection.

Foreign Asset Protection Trusts

For clients with significant exposure or international planning needs, foreign asset protection trusts offer unmatched protection. The Cook Islands set the precedent in 1984 with the creation of the world’s first self-settled spendthrift trust. Today, jurisdictions such as Belize, Nevis, and the Cayman Islands offer similarly strong statutes.

What makes these trusts effective is their resistance to foreign judgments and their high burden of proof requirements. In the Cook Islands, for example, a creditor must litigate from scratch under local law, pay fees upfront, and meet the strictest burden of proof: “beyond a reasonable doubt.” Contingency fee arrangements are not allowed, and losing parties often bear both sides’ legal costs.
